What is a wet signature?

A wet signature is a signature written by hand, in ink, on a paper document. The name comes from the ink, which is wet when the signature is made. It's the traditional way to sign, and it's what people mean when a bank, court or agency asks for an original or wet-ink signature.

Wet signature meaning

The term became common once electronic signatures arrived and people needed a word for the old kind. A wet signature is made with a pen, on the paper itself. A photocopy, fax or scan of a signed page shows a wet signature, but it's a copy: when an organization asks for the wet-signed original, it means the paper the signer actually signed.

A picture of a handwritten signature pasted into a document, or a signature drawn with a finger or stylus on a screen, isn't a wet signature, even though it looks like one. Both are electronic signatures.

Wet signature vs electronic and digital signatures

An electronic signature is any electronic sign that a person agrees to a document: a typed name, a drawn signature or a click on an I agree button. A digital signature is a technology rather than a way of signing: a certificate-based seal that shows whether a file has changed since it was signed. E-signature services often use both, recording each signer's consent and identity, then sealing the finished PDF with a digital signature.

Each kind relies on different evidence. A wet signature is checked by comparing handwriting and, for important documents, by a notary or witnesses who saw it being made. An electronic signature relies on records instead: the signer's consent, how they were identified and an audit trail of who did what and when.

When a wet signature may still be required

In the United States, the federal ESIGN Act and state laws based on UETA give electronic signatures the same legal effect as wet signatures for most transactions, but ESIGN lists exceptions, and states can have their own. The exceptions include wills, codicils and testamentary trusts, adoption, divorce and other family-law matters, court orders and official court documents, and some notices, such as cancelling utility services or a foreclosure or eviction notice on someone's home. Some states now allow electronic wills or remote notarization, so the rules depend on where you are.

Nobody has to accept an electronic signature, either. A bank, government office or the other party to a contract can ask for paper and ink, and documents signed before a notary or witnesses may need an original. If you're not sure, ask whoever requested the signature. This is general information, not legal advice.

How to sign without paper in PDFZyro

  1. To sign a PDF yourself, open it with Sign, type, draw or upload your signature, place it and click Finish to download a sealed copy.
  2. To get other people's signatures, send a signature request: add each signer's name and email and place their fields. They sign in the browser, without an account.
  3. When everyone has signed, you get the sealed PDF, a certificate of completion and the audit trail. If a wet signature is required, print the document for signing in ink and keep a scan of the signed original in your library.
